“Justice Binta Nyako Denies Nnamdi Kanu’s Request for Bail Restoration and Removal from DSS Custody”
Nnamdi Kanu, the leader of the Biafra nation agitators, faced a setback as his request to have his revoked bail reinstated and to be moved from the custody of the Department of State Services (DSS) was dismissed by Justice Binta Nyako of the Federal High Court in Abuja.
In her ruling on Monday, Justice Nyako highlighted that Kanu had previously brought a similar request before her, which was dismissed for lack of merit. She emphasized that Kanu had breached the conditions of his bail by fleeing the country, indicating his disregard for the court’s authority.
Furthermore, the judge noted that the sureties who had stood for Kanu in his earlier bail application had applied to be discharged, as they could not locate him and were unaware of his whereabouts. This further compounded the challenges surrounding Kanu’s bail status.
Justice Nyako refuted claims by Kanu’s lead counsel regarding a Supreme Court judgment that purportedly supported the reinstatement of Kanu’s bail. Upon examining the Supreme Court judgment, the judge found no such assertion and emphasized that Kanu’s only recourse now was to appeal the decision at the Court of Appeal.
With this ruling, Nnamdi Kanu remains in DSS custody, and his legal team must now explore other avenues, including appellate options, to challenge the court’s decision.
